Abstract

The article aims to analyze the increasingly intense process of judicialization of health access, specifically when regarding to rare diseases, the public policies that are currently being coordinated in the health area, their constitutional anchorage and the judicial activism (lobby) applied to the health area. It will also examine the positioning of Brazilian Superior Courts, specially concerning the principle of reserve for contingencies, the health rights themselves and the private health insurances expected procedures.
